Beyond Law’s client, a 25-year-old man and aspiring firefighter, suffered serious orthopedic injuries with near leg amputation and a traumatic brain injury when he was struck by a piece of stolen road-building equipment. The thief fled the scene and was never found and left our client for dead, and there were no witnesses to the crash. In the circumstances, our client’s only recourse was to sue the equipment owner for failing to properly secure it at the construction site. This was not an easy case, as the Supreme Court of Canada has held that the owner of a motor vehicle does not owe a duty of care to an individual harmed by the use of that vehicle. Nevertheless, with the benefit of an expert opinion from a retired police officer and heavy equipment theft expert, and a thorough and effective examination for discovery, Josh Nisker of Beyond Law was able to successfully settle the case at mediation to our client’s immense satisfaction.

Beyond Law’s client, a Chinese exchange student attending university in Ontario was rendered a quadriplegic after suffering a complete spinal cord injury as a result of a single-vehicle collision on Highway 401. She was deemed “catastrophically impaired” by her accident benefits insurer. With the help of Beyond Law, an expert team of healthcare practitioners specializing in spinal cord injuries was assembled to assist her in her recovery. Beyond Law successfully obtained funding from the insurance company for our client’s treatment, personal care assistance, suitable housing, and assistive devices, as well as travel to and from China for our client’s family.  Beyond Law also worked in coordination with immigration lawyers to assist our client with student visa issues that arose following the collision and posed a risk to her treatment and recovery. Beyond Law’s client suffered a psychological injury and emotional trauma after her plastic surgeon breached her trust and privacy by posting nude “before and after” photographs on social media without her consent. The photographs were taken during a medical appointment and were purportedly required to provide care and treatment to our client.
